At the court (Source: VNA) Hanoi (VNA) – TheHanoi People’s Procuracy on March 7 proposed 12-60 month imprisonment sentencesto nine defendants in the Da River water pipeline’s 18 successive ruptures.
Accordingly, a 36-42 month imprisonmentwas sought for Hoang The Trung, former Director of the management board of theDa River water supply system investment and construction project; and Tran CaoBang, former Director of the Vinaconex Glass Fiber Reinforced Polyester PipeJSC.
Meanwhile, a 30-36 monthimprisonment was suggested for Nguyen Van Khai, former Deputy Director of themanagement board of the Da River water supply system investment andconstruction project; Vu Thanh Hai, former head of the production division,former workshop foreman, and former Deputy Director of the Vinaconex GlassFiber Reinforced Polyester Pipe JSC; and Do Dinh Tri, former official of theVietnam Water, Sanitation and Environment JSC (VIWASE) under the Ministry ofConstruction, and former chief of the consultant and monitoring team at the DaRiver water supply project.
The procuracy demanded prisonterms of 24-30 months for Truong Tran Hien, former head of the materials andequipment division of the management board; and the same term on probation for HoangQuoc Thong, former official of VIWASE, former overseer at the Da River watersupply project.
A 15-18 month and 12-15 monthjail term on probation was suggested to Bui Minh Quan, Deputy Director of theequipment construction and business company under the VIWASE, former overseerat the Da River water supply project; and Nguyen Bien Hung, former official ofVIWASE, former deputy head of the consultant and monitoring team, respectively.
They were prosecuted forviolating construction regulations causing serious consequences as stipulatedin Point b of Clause 2 under Article 229 of the 1999 Penal Code.
According to the indictmentof the Supreme People’s Procuracy, the Da River water supply project, investedby the Vietnam Construction and Import-Export Joint Stock Corporation(Vinaconex), was built from 2004 to April 2009.
From February 4, 2012 toOctober 2, 2016, 23 fiberglass-reinforced composite pipelines were broken for18 times, forcing the Vinaconex Water Supply company – the operator of thepipeline system – to spend more than 16.6 billion VND (732,000 USD) to fix thebroken lines.
The broken pipelines haltedthe supply of more than 1.74 million cu.m. of water to 177,000 households inHanoi for a total of 386 hours.
The inspection conclusion onApril 15, 2015 confirmed that the ruptures were caused by violations in thepipeline production process and the management and monitoring of the pipelineconstruction.
During the investigation, thepolice agency for investigation under the Ministry of Public Security alsolaunched criminal proceedings against seven persons for the charge of violatingconstruction regulations causing serious consequences. They were Phi Thai Binh,Chairman of the Vinaconex board of directors; Nguyen Van Tuan, member of theboard of directors and General Director of Vinaconex; Hoang Hop Thuong, Vu DinhCham and To Ngoc Thanh, members of the board of directors; Lai Van Bich,Director of the project management board; and Nguyen Duc Luu, head of the investmentdivision of Vinaconex.
They allegedly decided tochange the pipeline material from ductile iron to fiberglass-reinforcedcomposite when they had not verified the effectiveness of the change. They alsoallegedly assigned the Vinaconex Glass Fiber Reinforced Polyester Pipe JSC toproduce and supply pipelines to the project when the firm had just beenestablished and not had enough capacity to carry out the work.
However, inspectors of theConstruction Ministry said on September 30, 2016 that the change of materialdid not cause the ruptures, and the assignment of the work to the VinaconexGlass Fiber Reinforced Polyester Pipe JSC was in line with the accused’ scompetence and the project investment format.
On December 14, 2017, theSupreme People’s Procuracy overturned the criminal proceedings against theseven abovementioned persons.
The trial is scheduled tolast through March 15.-VNA
